Terms of Service

Your use of the AirwaySim Educational Edition implies acceptance of these Terms of Service.

Definitions

AirwaySim Educational Edition refers to the hosted online airline management simulation service provided by AirwaySim for educational institutions.

Customer refers to the educational institution purchasing the service.

Users refers to lecturers, instructors and students authorized by the Customer to access the service.

General terms

Description of the Service

AirwaySim Educational Edition is provided as a commercial off-the-shelf (COTS) Software-as-a-Service (SaaS) product. Commercial terms, including pricing, service level, support, license duration and cancellation terms, are defined in the applicable quotation or other written agreement between AirwaySim and the Customer.

System requirements

No software installation is required. The Service is accessed through a modern web browser using a standard computer or tablet device.

No warranty

AirwaySim makes reasonable efforts to maintain uninterrupted availability of the Service. However, due to the nature of the Internet and hosted services, uninterrupted availability cannot be guaranteed. AirwaySim shall not be liable for temporary interruptions, delays or unavailability of the Service beyond its reasonable control.

Order of precedence

If these Terms of Service conflict with an applicable quotation or other written agreement between AirwaySim and the Customer, the quotation or written agreement shall prevail.

Intellectual property rights

Ownership

All intellectual property rights relating to the AirwaySim Service, including the software, website, documentation, game mechanics, graphics and other content, remain the exclusive property of AirwaySim unless otherwise stated.

The Customer retains ownership of its own teaching materials and other content submitted to the Service. The Customer grants AirwaySim the right to store and process such content solely for the purpose of providing the Service.

License

AirwaySim grants the Customer a limited, non-exclusive and non-transferable license to use the Service in accordance with the applicable quotation or written agreement.

Restrictions

The Service or any part of it may not be copied, modified, redistributed, reverse engineered or otherwise used beyond the rights granted by these Terms or the applicable agreement.

User accounts

Authorized users

User accounts are intended solely for the use of the Customer and its authorized lecturers, instructors and students during the licensed period. Each user account is intended for use by a single individual.

Account security

Users are responsible for maintaining the confidentiality of their login credentials. The Customer should notify AirwaySim without undue delay if any unauthorized use of the Service or user accounts is suspected.

Privacy

Privacy policy

The processing of personal data is governed by the AirwaySim Educational Edition Privacy Policy.

Customer references

Unless otherwise agreed in writing, AirwaySim may identify the Customer as a user of the AirwaySim Educational Edition in customer reference lists and marketing materials.

Termination

AirwaySim reserves the right to suspend or terminate access to the Service in the event of a violation of these Terms. Commercial termination, license duration and cancellation conditions are governed by the applicable quotation or written agreement.

Governing law

These Terms shall be governed by the laws of Finland. Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of Finland.

Changes to Terms

AirwaySim reserves the right to update these Terms of Service from time to time. The latest version will always be available on the AirwaySim website.
